The particular law that the American lawyers tried to use was one originally passed for cases of piracy. It was defeated by the little known notion of sovereign immunity. I am sure the lawyers knew this to be the case before they even filed. I do not believe in universal jurisdiction in the case of war crimes. I much prefer ad hoc tribunals which are, hopefylly, less politicised. The tribunals for the former Yugoslavia are a case in point.
