Convicted sex offender sent home instead of to prison

Supreme Court Justice Edmond Levy on Tuesday ordered the prison term of a convicted sex offender delayed, because the court could not hear Moshe Gorelik's appeal before he would have served most of his sentence.

Levy said he had decided to delay Gorelik's jail time because of the court's heavy caseload. Hearing Gorelik's appeal so late into his jail term would essentially render the matter moot.

In March, the Tel Aviv District Court convicted Gorelik, 56, a Kung Fu instructor, of statutory rape, for having sex with a 17-year-old, and of performing indecent acts on a 14-year-old.

He was sentenced to 30 months in prison and an 18-month suspended sentence, and ordered to pay each victim NIS 15,000 in compensation.

"This is a terrifying example of how the overloaded court situation has harmed the two victims," said Dr. Dana Pugach, the head of the Noga Center for Victims of Crime. "Suspects, and even convicted sex offenders such as Gorelik, are freed and often even free to flee the country without paying for their acts," she said.

It is unreasonable for a convicted sex offender to continue life as usual, due to a shortage of judges and overloaded courts, until the Supreme Court sets a distant court date for an appeal, she said.

The State Prosecutor's Office objected to the Gorelik's appeal.

However, Levy did order the district court to increase significantly Gorelik's cash bond.
