Katsav could face civil suits over sexual assault charges By Tomer Zarchin Two of the women allegedly molested by former president Moshe Katsav are considering filing civil suits against him in parallel to the criminal proceedings. The first woman, A., worked under Katsav when he was tourism minister, and she is the focus of the amended indictment that will soon be submitted against Katsav. She recently met with attorney Boaz Arad to discuss the chances of a civil suit against Katsav. Advertisement However, Arad refused to comment on what was decided at that meeting, and other people close to A. said she was waiting to see the outcome of the criminal trial. The second woman, also known as A., worked under Katsav at the President's Residence. Thus far, her complaints have not been included in the indictment against Katsav, because the prosecution believes the evidence is insufficient. Her associates confirmed yesterday that she plans to file a civil suit against the former president if her latest attempt to change the prosecution's decision on her criminal complaint - a petition to the High Court of Justice - fails. A legal source commented that while a criminal conviction would make a civil suit against Katsav much easier, it is not a necessary precursor to such a suit, as the burden of proof in civil suits is lower than that in criminal cases. Yesterday, the state submitted its response to the second A.'s High Court petition, which demands that she be allowed to confront Katsav before prosecutors decide against including her complaints in the indictment. Most of the arguments in the state's response were procedural: for instance, that A. has already submitted two previous petitions against the prosecution's decision, both of which the court rejected unanimously; and that the current petition is unjustifiably belated. The state also argued that the police have complete discretion as to whether or not to stage a confrontation. A.'s lawyer, Ariel Bendor, charged in response that the state offered no substantive argument for why A. should be denied such a confrontation.
