Man sentenced to six months community service for deaths of 8 relatives

A 34-year-old Kfar Kassem man was sentenced to six months of community service Tuesday after a court convicted him of manslaughter in the deaths of eight of his relatives in a road accident that occurred three years ago.

Ayoub Abu-Tzaluk was behind the wheel of his vehicle carrying eight family members as it was traveling on Highway 5. During the course of the trip, Abu-Tzaluk took an illegal U-turn, was rammed from behind by a trailing vehicle, and then collided with an oncoming car from the opposite direction. The impact of the initial collision sent the car hurdling towards oncoming traffic, causing it to collide with two other cars.

Abu-Tzaluk's brother, Daoud, his wife, and their six children ? whose ages range from six to nine ? were killed in the accident. The court accepted Abu-Tzaluk's claim that the loss of his family constitutes an extremely heavy punishment

According to the indictment, Abu-Tzaluk set out from his home village of Kfar Kassem to the A-Zawiya Bridge, where his brother and his family were awaiting him. After picking them up, Abu-Tzaluk wanted to return to Kfar Kassem, so he made the U-turn which is designated for emergency vehicles only.

While driving along in the left lane of the highway, Abu-Tzaluk noticed a breach in the divider. As he reduced speed to make the turn, a trailing vehicle driven by Oved Chai, of 34-year-old Ramat Gan resident, rammed into Abu-Tzaluk's car. Chai was accused by the court of failing to keep a minimum safety distance between vehicles as mandated by law and of inadequately reacting to the vehicle slowing down before him.

The collision caused Abu-Tzaluk's vehicle to overturn in the air and veer into an adjacent lane marked for oncoming traffic from the opposite direction. Two other vehicles collided into that of Abu-Tzaluk, causing him to suffer from dizziness. The passengers were flung from inside the vehicle and killed.

The State Prosecutor's Office argued that the highway measured up to adequate safety standards, the road was dry, weather conditions were good, the visibility was excellent, and the lighting on the road was functioning as per usual.

"Or Yarok," the non-governmental organization dedicated to reducing traffic fatalities in Israel, slammed the court for what it alleges is its whitewashing of the state's lax policies towards highway safety.

"This instance joins others in which the court is too forgiving and hands down light sentences to drivers who caused the death of innocents," the group said. The director-general of "Or Yarok," Shmuel Abuhab, told Army Radio that "the court needs to be part of the campaign against road accidents that have turned into a national epidemic.
