Holocaust survivors from former Soviet Union awarded NIS 19 million

A Tel Aviv District Court on Sunday awarded NIS 19 million to 1,365 Holocaust survivors who had escaped to the former Soviet Union before emigrating to Israel.

Judge Oded Modrik ruled that the Claims Conference - which negotiates compensation and is responsible for transferring funds from Germany to Holocaust victims - neglected to inform survivors from the former Soviet Union that they were entitled to a one-time restitution payment upon their arrival in Israel.

The lawsuit was filed in 2002 by the organization Children of War, which represented 1,915 Holocaust victims who sued the Claims Conference. The claimants argued that the committee, operating in Israel, set additional criteria for compensation that did not appear in the German government's original decision.

The committee argued that the claimants were not entitled to sue because they did not meet the criteria and hadn't proven that they had been persecuted. As a result, their claims expired.

Judge Modrik rejected three of the committee's claims and ruled that 550 out of the 1,915 plaintiffs' claims had expired.

Attorney Yoram Sheftel, who represented the Holocaust survivors, said "I am satisfied with the ruling that applies to two-thirds of the claimants." But Sheftel said he was shocked that the court accepted that the argument that the other 550 claims had expired and is planning to appeal to the Supreme Court on behalf of those whose claims were denied.

The committee's attorney Uri Keidar also intends to appeal the ruling, and has requested that the decision be delayed until the court renders its final rulings.
