Katsav accuser demands face-to-face confrontation

A. from the President's Residence is demanding that the police hold a face-to-face meeting between her and former president Moshe Katsav. She petitioned the High Court of Justice yesterday to order Attorney General Menachem Mazuz to hold such a confrontation.

A., whose complaint was not included in the original indictment after sex offenses first emerged in 2006, claims that the former president raped her. Earlier this spring, Katsav withdrew from a plea bargain in a bid to clear his name in court.

A.'s attorneys, Prof. Ariel Bendor and Eldad Yaniv, claim in the petition that because Katsav withdrew from the plea bargain, and in light of additional investigative steps being taken, there is a basis for holding a confrontation.

The petition states that A.'s lawyers repeatedly asked Attorney General Mazuz to hold the face-to-face meeting, but when their request was not granted they decided to appeal to the High Court.

A source involved in the Katsav investigation said yesterday that an indictment was expected within weeks. The file is now being studied, and the question of additional investigations is under examination. Also, new developments since the now-canceled deal with Katsav are being looked at.

The source added that State Prosecutor Moshe Lador is studying the case, because most of the events took place before he took office.

In addition, the latest corruption investigation into Prime Minister Ehud Olmert is taking time away from the Katsav case, and more time will be needed to make a decision regarding the former president.

A.'s complaint was removed from the draft indictment against Katsav that was prepared for the plea-bargain agreement. Mazuz said he had found evidentiary problems with her testimony, in which she claimed that Katsav had raped her and committed indecent acts.

Her lawyers say that not only had she demanded a confrontation, but agreed to take a polygraph test, which found her to be telling the truth. Nevertheless, a confrontation never took place, even though this procedure is relatively common in similar sex-offense cases.

The petition also states that completing the investigation relating to A.'s claims would shed light on the gaps Mazuz found in the evidence.
