Court: Kibbutz must pay for denying entry into club over skin color

The Haifa District Court on Tuesday instructed the Ramot Menashe Kibbutz to pay 28-year-old Yizhak Mizrahi NIS 50,000 in compensation for not allowing him to enter the Kibbutz dance club "Terminal" due to the dark color of his skin.

Mizrahi arrived at the club in June 2004 with his girlfriend and three other friends. His four companions, who are light-skinned, were allowed entry by the selector while Mizrahi was left to wait outside. After a half an hour wait, Mizrahi turned to the selector and asked him why he was not allowed inside. The selector responded that it was only a temporary delay but during this time he allowed other people into the club.

Finally, according to the verdict, the selector told him that the club manager, Shlomo Binyamin, had instructed not to allow Mizrahi or another Sephardic looking man into the club since they "didn't look right to him." When Mizrahi asked to speak in person with Binyamin, he brushed him off. In light of the incident, Mizrahi had to leave the location humiliated.

In their ruling, the court agreed that the club was a public place and thus the manager's prejudice was unacceptable.

"Barring the entry of Sephardim into bars and clubs is a negative phenomenon that occurs mostly in privately owned venues and must be dealt with," the ruling said.

"The color of someone's skin can never be criteria for entry into a club. Moreover - and we want to make this as clear as possible - it can never be an indication of how someone will behave."
