Court demands State explain how it will prevent Gaza crisis

The High Court has instructed the State Prosecution to explain within a week how planned cuts to the Gaza Strip's power supply will not a cause a humanitarian crisis to the residents of the coastal territory.

The court decided to issue the instruction after justices reviewed petitions presented by several human rights organizations seeking to stop the government's plans to scale back the supply of fuel and electricity to the Strip.

The order also requires the state demonstrate that authorities can accurately monitor the impact of their actions.

Israel began reducing fuel shipments to Gaza nearly two weeks ago, in response to ongoing rocket fire targeting sites in the western Negev. It had planned to periodically cut the coastal territory's electricity supply as well, but Attorney General Menachem Mazuz temporarily nixed the plan.


"We know that there is already damage to the energy and civilian infrastructures in Gaza since they reduced the fuel flow to Gaza," Noga Eitan, spokeswoman for the organization "Gisha" said after the court hearing. "We expect the state to lift the embargo."

Attorney Dana Briskman, who represented the State Prosecution at the High Court hearing, said that Mazuz did not issue a blanket ban on all plans to reduce Gaza's electrical supply, and that an "alternative plan is being worked on."

Briskman said that Mazuz did allow for the limiting of fuel supply to the Strip, and added that cuts to the electrical supply are a future possibility. Briskman asserted that a 15 percent cut in the fuel supply to Gaza "is not a humanitarian crisis and does not come close to being one."

Human rights organizations presented the opposite view, maintaining that the cuts in fuel will set a precedent that will let Mazuz okay electricity cuts in a roundabout way, a move that they asserted would lead to a humanitarian crisis.

The State Prosecution argued that cuts in Gaza's power supply are appropriate, considering the area is controlled by Hamas, an organization that calls for the destruction of the State of Israel, and is used as a base for militants who launch regular rocket attacks against Negev civilians.
