IDF asks court to freeze war report until officers can respond

The office of the Military Advocate General (MAG) petitioned the High Court of Justice on Monday to halt publication of the final Winograd Report, until the officers that may be harmed by its findings have a chance to respond.

Although the Winograd Committee announced Sunday that its final report would not contain conclusions about individuals, MAG is reportedly concerned that the committee's stated intent to release its findings before the end of 2007 constituted a reversal of its September pledge to the High Court - to allow officers named to be heard - and would place its conclusions, including criticizing specific officers, before the cabinet without allowing them the right to a hearing.

MAG, represented by the Chief Military Defense Council Colonel Orna David and Lieutenant Colonel (res.) attorney Joseph Benkel, told the court that the committee's position was "a 180-degree change from its position two months ago to the High Court."

The High Court is also to hear a petition next week by MAG and the Movement for Quality Government against the Winograd Committee.

The court's ruling will determine whether the report is published within two months, or postponed for several months by granting the officers' a right to hearings.

Attorney General Menahem Mazuz is to present his opinion to the leadership of the Winograd Committee next week.
