Court forbids lease of moshav land to Bedouin farmer

A Kiryat Gat court on Monday issued a temporary injunction banning a local Bedouin man from leasing agricultural land belonging to Moshav Nevatim in the Negev.

The injunction was issued following a request from the moshav's administrative council which stated that the land in question was leased to Ahmed Terabin for a period of ten years without the approval of the moshav's "acceptance committee."

Vice-president of the Magistrate's Court Tali Haimovitz dismissed the moshav's claim stating that the lease was deferred for "racist reasons." Haimovitz stated that if the land is leased to Terabin, it could represent a serious disruption in the character of the community, especially in light of Terabin's statement that he intends to move his entire family to the property, including a number of grown women and twenty-two children and grandchildren.

An attorney for the moshav stated that the owner of the land requested to sell it to someone of minority descent, but presented the sale as a lease only, in order to circumvent the requirement for acceptance committee approval for the sale of moshav land to a third party.

The court's order ruled that the lease of the property will not be allowed without approval of the moshav's acceptance committee, and that any lease without the committee's approval would be a serious deviation forbidden under the settlement law
