Court gives war panel 10 days to justify lack of personal findings

The High Court of Justice ordered the Winograd Committee on Friday to reply within 10 days to a petition filed by the Movement for Quality Government, which demanded that the panel's final report on the Second Lebanon War include its conclusions regarding individual officials.

The Winograd Committee is not expected to include individual recommendations in its report, nor does it plan to send letters of warning to those mentioned as responsible for the failures of the war.

The final report is expected to focus solely on general and systemic conclusions.

Justice Esther Hayut rejected the movement's request to issue a temporary injunction against the committee, which would prevent it from publishing its report until a legal decision has been made on the matter.

The committee, headed by retired justice Eliyahu Winograd, announced Thursday that it planned to publish its conclusive report by the end of the year.

In its petition, the group asked the court to issue a temporary injunction against the committee which would prevent it from publishing its report until a legal decision has been made on the matter. The movement also asked the court to hold urgent deliberations on its petition.

Shortly after the panel's announcement on Thursday, the military's legal defense team said it planned to appeal to the High Court over the terms of the report's publication.

The defense team accused the panel of failing in its obligation to give the individuals mentioned in the report a chance to respond to the findings against them.

The committee contends that if the final report only has general and systematic recommendations, and not personal ones, there is no reason to send out warning letters that would delay the release of the report.
