Justice Min. bill calls to reduce judges at regional courts

Justice Minister Daniel Friedmann on Tuesday recommended reducing the number of judges presiding over regional court hearings from three to two for the first time since Israel gained independence in 1948.

Friedmann submitted a draft bill designed to increase the judicial system's efficiency after examining conclusions reached by a 1997 panel that sought to expedite cases by reducing judges' work loads.

"The proposal is designed to reduce the number of procedures taking place in regional courts presided over by three-judge panels, thereby reducing these courts' heavy work load without losing the advantage of having more than one judge hearing a case," a Justice Ministry statement said.

Under the bill, appeals of verdicts handed down by magistrate's courts will still be heard by three-panel judges at regional courts, and civil suit appeals will be heard by two judges.

According to the bill, two judges may agree on a verdict instead of three but a third judge can be brought in where their opinions are irreconcilable.

Other matters will be brought before a single judge, including civil suit appeals worth less than NIS 100,000.

Under the British Mandate the judicial system called for only two judges, however when Israel gained independence in 1948 the Justice Ministry introduced regulations stipulating that an odd number of judges must preside over every case.
