Winograd panel says it will warn those implicated in report

The Winograd Committee's attorney, Zvi Agmon, told the High Court of Justice on Tuesday that the panel would send out warning letters to those who may be potentially harmed by its final report on the Second Lebanon War, while allowing those warned to review the relevant evidence against them and plead their case in a hearing.

Agmon spoke during a High Court hearing regarding two petitions filed by the Israel Defense Forces' legal defense department and former MK Avraham Poraz on the right of response extended to individuals who could be adversely affected by panel's final report.

The Winograd panel's attorney added that the committee could not promise that those warned would be allowed to cross-examine witnesses. Agmon said that the decision regarding the right to cross-examine witnesses would be made individually for each person who receives a warning letter.

Supreme Court President Dorit Beinisch, who heard the petitions, said that Agmon's statement would be written in the court's protocol and will also appear in the High Court's final ruling on the matter.

Last week, the committee told the court that it did not yet know which individuals stand to be affected by its final report, or to what extent, but reiterated its commitment to send warning letters to those individuals and to enable them to argue their case before the final version of the report is completed.

In its statement, the committee emphasized the need to balance "respect for the rights of the potentially injured parties with the need to publish the final report as soon as possible."

Earlier this week, Mazuz similarly told the court that the petitions should be rejected because they were submitted before the committee had decided which individuals stand to be affected by the report's conclusions and the extent of the damage they are liable to suffer. However, he also recommended that the right of response granted by the committee be similar to that granted by a state commission of inquiry - a position the committee has thus far rejected.
