State to reveal witness' identity in Jaffa mob murder, abduction trial

Tel Aviv District Court's prosecution told the court Sunday it will reveal the identity of a witness whom the police used in a murder and kidnapping trial in January.

The case is of the July 2005 murder of Khader Daka, who allegedly mediated in a dispute between the owners of Benny Hadayag, a fish restaurant in the old Tel Aviv port, and a Gaza fisherman.

The prosecution is to give the court its source's full identity by Tuesday afternoon.

At the trial in January of the five defendants in Tel Aviv District Court, the judge ordered police to reveal the identity of the witnesses in view of the crucial nature of their testimony. The police refused, and the court acquitted the suspects.

According to the charge sheet, the suspects were Jaffa-based hit men hired by the restaurant owner, Benny Raba, to kill Daka.

The prosecution charged Izzat Hamad, its main suspect and head of Jaffa's largest crime gang, with murdering Daka because of his arbitration in the dispute.

The indictment said Hamad met Daka and his cousin Aslam Daka on July 16, 2005. Hamad and four friends attacked and bound the two and put them into the boot of a car. Daka and his cousin managed to escape, but the assailants chased them, shooting and killing Daka. Aslam escaped.

Following Tel Aviv District Court's January acquittal of the suspects, the prosecution appealed to the Supreme Court, whose justices approved the petition and told the district court to re-open the trial in order to hold a further hearing on the issue of the source's identity.

The district court ordered the prosecution three weeks ago to reveal the name of its source.
