The parents of a Palestinian child who was shot dead by IDF soldiers near Tul Karm in December have filed a compensation suit against the state.

The father of 14-year-old Doaa Abd al-Qadr, who has been in police custody on suspicion of auto theft for five months, is due to be released Tuesday.

"Doaa returned from school that day as she always had, accompanied by a 12-year-old friend" the suit, submitted to the Jerusalem Magistrate's Court, begins.

The two girls passed close to the separation barrier near Faroun Village in the Tul Karm province, when IDF soldiers opened fire at them. Doaa was fatally wounded and taken to Beilinson Hospital, where she died. An inquiry concluded that the soldiers mistook Doaa for a terrorist.

GOC Southern Command Yair Naveh, who probed the incident, dismissed the soldier who shot Doaa and his commander.

The parents' lawyer, Rami Otman, asked the Defense Ministry for the inquiry's findings but did not receive it. Otman says in the suit that inquiries have shown that the state has in fact admitted its responsibility for the child's death.

The suit does not name a sum of money, but the parents are asking for compensation for "pain and suffering," loss of income of the deceased in the lost years, compensation for penalty and psychological treatments for the family members. Otman said the family was in both mental and economic plight, especially in view of the father's arrest.

Al-Qadr had been arrested about two months before his daughter's death, near Kalansua, after entering Israel in search of work. He was accused of taking part in an auto theft incident although he denied being involved in it.

Hearing of his daughter's death al-Qadr asked to take part in his daughter's funeral. But two Tel Aviv District judges did not see fit to release him. Al-Qadr appealed to the High Court of Justice to be released at least for the three days of mourning. But Justice Asher Grunis scheduled the debate to take place after the mourning period.

Al-Qadr was finally released for the last day of mourning at the prosecution's initiative, and after MK Ahmed Tibi signed bail for him. He returned to police custody after three days with his family.

His lawyer's requests to revoke the charges against him were rejected. The court had recently ordered his release on NIS 25,000 bail, but it took the family several days to raise the money.
