Petah Tikva acted in bad faith, says judge

The city of Petah Tikva acted in bad faith when collecting taxes, Tel Aviv District Court judge Varda Alshech ruled yesterday. "I can only regret the fact that a city in the State of Israel chose, again, to act unlawfully, in a manner bordering on bad faith, knowingly impairing the rights of homebuyers, for the sake of money to which it was not entitled," Alshech wrote.

The trustee in charge of construction company DiRom sued the city, which was refusing to register apartments it had built on Katznelson Street.

The city claimed it was owed betterment tax on one apartment in one of the buildings and refused to issue permits until the tax was paid. However, the court pointed out, the city never sued to claim the debt, which was years old, and the statute of limitations applied. It had lost the right to the money, she ruled, and had behaved badly in trying to gain it at the expense of the homebuyers.
