High Court to IDF: Reconsider bound Palestinian shooting charges

The High Court of Justice on Sunday instructed the Military Advocate General to reconsider his decision in the case of the shooting of a bound Palestinian man in the West Bank village of Na'alin.

The soldier and his commander were formally charged with "improper conduct" at a military hearing earlier this month, but a number of human rights organizations petitioned the High Court claiming the charge was not severe enough.

Avihai Mandelblit, the army's top prosecutor, has said that the charge against the commanding officer, Lt. Colonel Omri Burberg, and Staff Sergeant L. is sufficient.

Mandelblit has also said that the High Court should not interfere with the military court decision, and that the charges filed against the two are the most fitting for the circumstances of the case.

Ashraf Abu Rahmeh, 27, was shot in the West Bank village of Na'alin during a July protest against the construction of Israel's separation fence there and in nearby Palestinian villages.

Abu Rahmeh was arrested when the demonstration turned violent and protesters began throwing stones at security forces.

An IDF soldier fired a rubber-coated metal bullet at Abu Rahmeh's foot from a distance of some 1.5 meters, while he was handcuffed, blindfolded and held by the arm by the soldier's commander.

The incident was filmed by a teenage Palestinian girl from Na'alin and the footage, published by the B'Tselem human rights group, sparked shock and outrage in both the Palestinian Authority and Israel.

Burberg was removed from his position and will be barred from serving in military command positions in the future, while the soldier was also demoted.
