Williger accuses Gaydamak of failing to provide mortgage to back $4.5m loan

Businessman Zwi Williger and his wife Ravit filed a NIS 17 million claim in the Tel Aviv District yesterday against tycoon Arcadi Gaydamak, saying that Gaydamak had received a 45-day, $4.5 million loan early this month, promising his home in Caesarea as collateral - which he failed to provide.

The Willigers say that Gaydamak undertook to mortgage his villa and register a mortgage caveat on the property in favor of the couple within eight days of signing the agreement. Because the caveat has not been registered, nor has Gaydamak provided the necessary documents for registering the mortgage, he is in breach of the loan terms. According to the claim, the agreement was signed about two and a half weeks ago.

The Willigers say that the NIS 16.2 million loan to Gaydamak was transferred to him through his company Ameris Holdings. According to the loan agreement, Gaydamak was supposed to pay interest of 1.5% for the entire loan period (45 days), or NIS 243,000, and an allocation fee of another NIS 243,000, the couple claims.

According to the court claim, the loan agreement stipulated that if the registrations were not executed according to the agreed-upon timetable, the loan, interest and allocation fee would be payable immediately, with an additional monthly interest of 3% for the period beginning on the date of the breach and until the loan is repaid.

The Willigers say that although Gaydamak has been notified that the mortgage has not been registered as agreed, and the loan is to be repaid immediately, Gaydamak has not responded or paid any part of his debt.

Last year, the former controlling shareholders of Willi-Food sold 45% of their holding in the company to Gaydamak at a 70% premium.
