Haaretz ordered to pay NIS 30,000 in violation-of-privacy case

The Supreme Court recently accepted a violation-of-privacy suit against Haaretz, its former editors and photographer Alex Levac.

The case began in January 2002, when Levac photographed Menashe Dror Tzadik by his kiosk in Tel Aviv's Dizengoff Center, where he sells religious books. The picture's background showed an advertisement in a nearby shop window that featured a man staring at a scantily clad woman with spread legs. Dror Tzadik objected to being photographed, but Levac promised that the picture was for his personal use only.

A month later, however, it was published in Levac's regular slot. Dror Tzadik then filed suit, claiming the publication not only violated his privacy, but slandered him.

The paper argued in response that since he chose to sell his books in a public place, his privacy had not been violated. Moreover, it said, Levac made no contract with him, nor was the photograph "humiliating."

The Tel Aviv Magistrate's Court ruled in Dror Tzadik's favor, but the Tel Aviv District Court overturned this ruling on appeal.

The Supreme Court, however, concluded that Levac had infringed on Dror Tzadik's privacy, in violation of an explicit contract. It therefore ordered Haaretz to pay him NIS 30,000 in compensation, plus legal costs
