Celiac patients force Elite to make gluten-free products in class-action

Celiac patients won a battle against Elite early this week, after the Tel Aviv District Court approved a compromise in a class-action suit. Under the compromise, the food manufacturer will produce food items specifically for Israel's celiac population for the next two years.

Efrat and Yehoshua Peled filed a NIS 357 million class-action against Strauss-Elite and its candy subsidiary in 2006, claiming that the companies had labeled kosher-for-Passover products as gluten free, which means they were safe for celiac patients. The couple later learned that the products did in fact contain gluten.

Under the compromise, specific Elite production lines will be cleaned and decontaminated twice annually, in order to meet strict European standards for gluten levels in products labeled as gluten-free (less than 10 parts per million). In addition, once a year, around Passover, production lines will be cleaned to meet even more stringent gluten levels.

Under the agreement, the products will cost the same as products for the general population that contain gluten, even though it costs substantially more to produce the former.

The claimants in the class action were awarded NIS 50,000 plus legal expenses.
