High Court slams gov't for shunning ruling on funding for yeshivas

The High Court of Justice on Sunday issued stinging criticism of the Education Ministry's evasiveness in abiding by 2004 Supreme Court ruling which forbade publicly subsidizing ultra-Orthodox educational institutions that refuse to teach their students the "core curriculum."

"The executive branch's avoidance of adhering to a legal ruling issued by a court of law is one of the most worrisome and serious dangers that threaten the rule of law in a democratic state," the High Court wrote. "From the answers given by the Education Ministry to the petitions, and from its arguments in court, it has become clear that the court's verdict in this process which was issued following the first set of proceedings was not enacted on time, and has not been enacted to this point, neither to the letter or to the spirit of the ruling."

Despite the 47-page opinion, though, the court will not invoke "operative orders" which would in effect put an immediate halt to funding of "small yeshivas" that do not teach the curriculum.

Last week, the Knesset approved a bill exempting yeshivas from teaching the "core curriculum" taught in all state-funded institutions. The Secondary School Teachers Union and the Israel Religious Action Center, who filed a petition with the court against the law, said they would consider using the judges' opinion as the basis of an additional petition against the law that was passed last week.

"As of this school year, the core curriculum has not been instituted in the secondary education institutions of the 'small yeshivas' in the ultra-Orthodox sector ? In the three years that have passed since the ruling, nothing of significance has been done by the Education Ministry to prepare for the introduction of the core curriculum," the judges wrote.

The judges also expressed disapproval of Education Minister Yuli Tamir's proposal of a year ago which offered to grant "small yeshivas" a temporary exemption from instituting the core curriculum, while at the same time changing the status of these schools from their current categorization - "unofficial recognized institutions," which receive 75 percent of funding that state schools receive - to "exempt institutions," which would entitle them to just 55 percent of funding
