Terror victims' relatives file NIS 450m suit against PA, Barghouti

The relatives of terror victims on Thursday filed a NIS 450 million class action lawsuit against the Palestinian Authority, the Palestine Liberation Organization and jailed Fatah leader Marwan Barghouti.

The plaintiffs, who filed the suit at the Jerusalem District Court, are the families of Givat Ze'ev residents Ronen Landau and Yoela Hen, who were killed some four years ago in two separate shooting attacks near their home.

Ronen landau was 17 when hew was killed in an ambush while on a highway traveling home with his father from Jerusalem. Yoela Hen, a mother-of-two who died at the age of 45, was killed while en route to a family wedding.

Barghouti has been in prison since April 2002, when he was convicted for a succession of terrorist activities against Israeli civilians in his capacity as the West Bank head of the Fatah-affiliated Tanzim militia.

The plaintiffs are represented by attorney Nitsana Darshan-Leiter, founder and direct of the Israel Law Center. The center files similar suits on behalf of terror victims in Israel and abroad.

Darshan-Leitner wrote: "We demand that the court determine a high and painful price tag for damaging the bodies and souls of Israeli residents, in order for the Palestinian side to understand that Jewish lives are not ownerless property.

"We hold significant evidence connecting the Palestinian Authority and its senior officials to the two terror attacks near Givat Ze'ev, as well as many other attacks," the attorney continued. "We have unequivocal evidence proving that Marwan Barghouti personally was responsible for the murder of Ronen Landau and Yoela Hen."

In the suit, the plaintiffs charged that Barghouti personally led, managed and orchestrated terror attacks against Israeli targets through conspiring to carry them out. They claimed that the jailed Palestinian leader did this with the assistance of senior operatives from Tanzim who were responsible for the actual execution of the attacks.

According to the plaintiffs, Barghouti was implementing policy that had actually been formulated by Yasser Arafat, the late PA chairman, before the second intifada erupted in 2000.
