| TERMS OF USE |
General
- The Ha'aretz site at www.haaretz.co.il ("the Ha'aretz site") offers Israeli and international news to Internet browsers.
- The company grants Internet site owners a non-exclusive, non-transferable licence, of limited duration, as provided below, to post a dynamic news link on the site owned by them ("the site").
- The service is subject to and conditional upon the users' agreement to these conditions and can be cancelled at any time by the company in its absolute discretion.
Definitions
- In these conditions the following expressions shall have the meanings appearing against them:
"The company" means Ha'aretz Daily Newspaper Ltd and anyone acting on its behalf;
"news" means any material or information displayed in the news link, in any media, including text, pictures, illustrations and graphics and the design thereof;
"dynamic news link" means a link, containing such news as determined by the Ha'aretz site operator from all the news published on the Ha'aretz site. The design of the news link and the content displayed in it will be in the company's absolute discretion ("the news link");
"The service" - several dynamic news links will be displayed on the Ha'aretz site, containing news published on the Ha'aretz site. The user may select one of the news links and post it on the site in accordance with the instructions that he will receive from the company after agreeing to these conditions. If visitors to the site ("browsers") click on the news link, it will direct them to the full articles and other news published on the Ha'aretz site;
"User" means whoever is the owner of an Internet site, of legal majority in his domicile and is in any event at least 18 years of age.
Users' Undertakings
- The user warrants and undertakes that by agreeing to these conditions he is not in breach of any law or contract by which he is bound.
- The user warrants and undertakes that the content published on the site does not and will not include:
- any material that infringes or breaches others' property rights;
- any racist or pornographic material or material of an explicitly sexual character or any other material that might upset public sensibilities;
- any material relating to minors and identifying them or their personal particulars;
- any unlawful material or material that encourages the commission of acts that constitute an offence under Israeli law or which might constitute the basis of a civil action;
- any material that is defamatory or infringes a person's privacy;
- any link or reference to material, the publication of which is prohibited by this clause.
Password
- The user's access to the service is made possible by means of a personal password ("the password"), which the company will allocate to the user. The password is personal to the user, who may not transfer it to any third party.
- The term of the contract between the company and the user shall commence from such time as the user confirms, in the manner set out below, that he accepts these conditions and it will continue so long as the password is in force and not blocked by the company, either at the user's request to stop using the service or at the initiative of the company in its absolute discretion.
Use of the News
- It is hereby expressed that the right to use the news link is personal to the user and solely for the purpose of posting it on the site. The user may not permit any third party to use the news, whether for or without consideration.
- The user undertakes to use the news link in accordance with the requirements of law and the instructions from time to time given by the company.
- The user undertakes not to edit, alter, subtract from or add to the content displayed in the news link.
- The user shall compensate the company for any claim, demand, damage or loss occasioned to the company as a result of the non-performance of these conditions or the breach of any provision of law by the user or the site's browsers.
Limitation of Liability
- The user hereby acknowledges that although the company acts insofar as possible for the news to be as correct and accurate as possible, there may be faults, errors and inaccuracies in the information and the way it is transmitted to the user.
- The company is not liable for the availability of the news, the content, form or accuracy of the data, faults in its transmission, the substance of the news, the non-conformity of the data received on the company's computer with the data received on the user's computer, or for any direct, indirect, consequential or other loss or damage occasioned to the user or any third party. The user hereby relieves the company of any liability for any such damage as aforesaid.
Intellectual Property
- The user acknowledges that the copyright, patent rights, trade secrets and rights of ownership in the news, including the distribution rights and all other intellectual property in the news, the news link and the password are the property of the company, and the user shall have no right whatsoever in them.
- The user undertakes not to publish the news or any of it except by posting the news link on the site. The user further undertakes not to publish any product or print-out of the news, whether printed graphically or as a report or given as a computer file on magnetic media or otherwise and that he will not duplicate, photocopy, reproduce or print any product or print-out as aforesaid of the news or any of it for the purpose of distribution or publication in any way whatsoever. The user further undertakes not, directly or indirectly, for or without consideration, to permit the performance of any of the above-mentioned acts.
- The user may not make any use of the company's trade and/or service marks, in Hebrew or English, whether or not registered, including any graphics that form part of them, without the company's prior written approval.
Additional Conditions
- The company reserves the right to modify these conditions for the use of the news link from time to time in its absolute discretion. In view of the aforegoing, the user is asked from time to time to review these conditions, which will be published on the Ha'aretz site, concerning the terms for use of the news link.
- It is hereby expressed that the company will be bound solely by these conditions.
- Exclusive jurisdiction in all respects relating to any dispute concerning the service shall rest with the competent court in the City of Tel Aviv, which shall try the case in accordance with Israeli law.
- I have read and understood these conditions. I agree to them and undertake to act in accordance with them. I acknowledge that the liability of the company, the Ha'aretz site operators and of all those acting on their behalves is subject to these conditions.
