Because this is occupied territory, and under the international humanitarian laws of occupation the "occupying power" is the ARMY OF OCCUPATION itself, not the state that sent that army in to occupy that territory.
So everything that has to have the patina of "legality" in the West Bank has to be buffed to a shine by a military order signed, sealed and delivered by...... the IDF Commander in the West Bank.
Who answers, of course, to Barak.
Who heads, of course, the Ministry of Defense.
