| Proportionality? You mean sending rockets into civilian areas? The reality is that it is you that has no comprehension of the legal content of proportionality. Proportionality is largely informed with doing what is necessary to stop an offensive assault. It permits heavy response to all souces of fire, even in civilian areas. In law, as opposed to politics, the wrong associated with this situation is the wrong committed by Hezbollah in firing from civiian areas. The other principle that has application to Israel`s response that in exercising self defence, responding to Hezbollah`s or Hamas`s attacks, Israel is not required to calibrate its response with "nicety". In short, international law permits a country under attack to err on the side of being overly aggressive. |
