Halacha is a legal system as well as a part of the Jewish practice. The worse thing that will happen is that the lawyers in Israel may lose some business if couple realize that they don`t need them to work out their pre-nups.
It could be argued that Halacha which based on "case law", rather than back room deals with judges and legal practitioners making hay behind the backs of the plaintiffs might work out better for a couple that is going through a divorce.
It has always amazed me that Roman Law, Code Napoleon, English Common Law, and all the other legal systems that are taught in Law Schools are considered Holy Writ, but Halacha is regarded as arcane and impractical. It`s time that we Jews learn to accept "our legal system" as co-equal, at least, with the way law is practiced in the State of Israel. |
