That is a pretty simple one to answer: 1) IF that losing army threw away its weapons when it threw away its uniform THEN it is "hors de combat", and the opposing force can`t keep shooting at them.
2) IF that losing army has kept its weapons even as it throws away its uniform THEN it is still a combat force, and the opposing army can still keep shooting at them.
What happens in (2) is that the opposing army has to be more careful about what it is shooting at, because that "un-uniformed" enemy is making it more difficult to distinguish combatant from civilian.
The upshot is that if the opposing army prevails then it can prosecute those soldiers for war crimes and, indeed, it can line the worst offenders up against a wall and execute them.
That`s the incentive to keep your uniform on if you keep holding your rifle. |
