You are correct. The Criminal Justice Act of 1990 was abolished and the death penalty reinstated, by the Anti-Terrorism and Effective Death Penalty Act of 1996..

The legal system is very precise. The charges are for specific acts, but thay are all treasonous. Pollard was not charged with treason since he was charged with espionage (spying). The country they were spying for, Israel, was not, and is not relevant to the decision by the AG to prosecute Pollard for espionage. Until 20006 no one has been charged fro treason for over 50 years. However, Pollard and others do fall under the common definition of treason. The technical distinction you attempt to make is ridiculous. A practical definition of treason is anyone who violates the duty of allegiance to ones state. Or a betrayal of trust. That would include spying for a foreign nation. You could argue that Pollard did not violate his allegiance to Israel and he was not spying for a foreign nation. However as far as Americans are concerned he is a traitor. There have been many high ranking Administration officials at that time, Sec of Defense Weinberg that holds a completely different view of what damage he caused to America.

What you are saying is that it is ok for any Jew to subordinating America?s interest to Israelis interest. That they should be exempt from the law because Israel is special. You believe that the reasons you state, if a Jew spies for a country that is not hostile, they are exempt from the law. What about other Americans that spy for other countries that are not hostile? Are they exempt as well? Or, only Jews?

You are mistaken that Israel is a friendly country. There is the USS liberty, the Lavon affair, the harassment and d attempted provocation by the Israeli IDF that harassed US Marines in Lebanon in 1983. In an attempt to provoke conflict between Arabs and the Marines. The list could continue. Israel is a political liability and moral embarrassment to America.

Why are you hiding behind the flag in a country of convenience rather than in Israel fighting for your real country? Or is defending your country in cyberspace, in the sanctuary of a distant country that you are not native to, as far as your devotion allows?
