People let`s get something clear. Even if the use of these shells are considered improper, which I doubt, there is no war crime. The shells weren`t used to target civilians and the military advantage warranted the risk to civilians.

The bar is not set at what is unpleasant. Targeting civilians is explicitly forbidden (which is what Hamas does) and as long as civilian casualties occur in the targeting of a military target there is no war crime. Period.

Finally and one last important point, civilians that are housed near a military target, lose their protection under International Law.
