The Rafah border crossing between the Gaza Strip and Egypt was supposedly turned over to the Palestinian Authority. In 1983, the Israel Supreme Court decided the Tsemel case which arose during the occupation of southern Lebanon. It ruled that occupation forces do not need to be in actual control of all the territory and population, but simply have the potential capability to do so. This ruling is in accordance with decisions of other courts, including the Naletili and Martinovi case in which the Yugoslav Tribunal referred to an occupant having "a sufficient force present, or the capacity to send troops within a reasonable time to make the authority of the occupying power felt."
Clearly, whilst Israel would prefer Egypt adopt the Gaza Strip as it`s own problem, it remains Israel`s responsibility as occupier, to safeguard the population and facilitate humanitarian requirements as necessary. Despite the efforts of some self appointed legal experts on here(mostly right wing idiots)this is of course the position of virtually all international legal specialists and the very bodies responsible for ensuring the application of Geneva and Hague conventions. Namely the ICRC and the UN. Thus barrack room lawyers (Jeff Northridge, who will likely pop up any moment) and his somewhat dimmer acolyte (CJK) can be safely discounted. |
