This is a religious issue. The NY Court of Appeals should decline to rule. Take the issue to some ruling body of the Faith or ask an Israeli court to rule.

It is bad precedent to ask US courts to rule on matters of faith. While there may be a small amount of wiggle room under the Constitution, the First Amendment was designed to keep the government out of endorsing one view over another.
