Hogwash. Voluntary intoxication is useful only as a defense against specific intent crimes (i.e. crimes in which a specific intent or state of mind is required for the defendant to be found guilty.)
If, for example, you get drunk and shoot someone, you may be able to avoid a murder charge that is based upon intent to kill. You will not, however, be able to use it as a defense against a murder charged based upon criminally negligent behavior. |
