that bodies in a cemetery must be reburied in a new place at the espense of the new owner of the property if he or she wishes to build there. Of course, when Jordan occupied Jerusalem for a few years, they destroyed the cemetery on the Mount of Olives, using the headstones for building latrines and paving roads. I would consider this a violation of the rights of Jews to rest quietly in their graves, rather than a restriction on the rights of the property owners. (And just as a noted, the apartment house was build when Polands was under communist domination and there were no individual property rights, all property belonging to the state. Poland is responsible for the old cemetery or acting to ensure the dead Jews (some of whom probably dies during the time the Nazis held sway in Poland) rest quietly in graves somewhere. |
