Mr Bishara`s situation as a person is of secondary interest to the public. The real issue has to be put on the table, giving general information of reasons for this process and thus to enable a real legal supervision of any type of criminal investigation.

To often the courts issue gag orders upon assistance of the investigating bodies police etc and when public pressure by media is applied this information restriction are removed rather soon. As known law in its process has to be observed and has to be in public not beyond curtain of gag order etc. Consequently our investigating rules should be changed to contain a provision that in addition to the investigating magistrates such an order should be authorized additionally by district judge.
